Health Insurance for Immigrants and Non-Citizens

January 19, 2026

Navigating the U.S. health insurance system can be challenging for anyone, but it presents unique hurdles for immigrants and non-citizens. The rules governing eligibility for health coverage vary based on immigration status, length of residency, and the state you live in. Understanding your options is the first step toward securing the healthcare you and your family need.

Marketplace and Medicaid Eligibility by Immigration Status

Lawfully present immigrants — including green card holders, refugees, asylees, and those with valid work visas — are generally eligible to purchase health insurance through the ACA Marketplace and may qualify for premium tax credits and cost-sharing reductions based on income. Lawfully present immigrants who are ineligible for Medicaid due to the five-year waiting period may qualify for Marketplace coverage with subsidies regardless of income, a provision that makes coverage more accessible during those initial years.

Undocumented immigrants are not eligible to purchase coverage through the ACA Marketplace or enroll in Medicaid (with the exception of emergency Medicaid in most states). However, there are still options available, including community health centers that provide care on a sliding fee scale, free clinics, and some state or local programs that extend coverage regardless of immigration status.

Key Programs and Resources

  • Emergency Medicaid: Available in all states for emergency medical conditions regardless of immigration status, covering situations like emergency labor and delivery or life-threatening conditions.
  • Children's Health Insurance Program (CHIP): Many states provide CHIP coverage to children of lawfully present immigrants without a waiting period, and some states cover children regardless of immigration status.
  • Community Health Centers: Federally Qualified Health Centers (FQHCs) serve patients regardless of their ability to pay or immigration status, offering primary care, dental, mental health, and pharmacy services.
  • State-specific programs: Several states, including California, New York, and Illinois, have expanded their own coverage programs to include immigrants who do not qualify for federal programs.

Protecting Your Information

It is understandable to have concerns about sharing personal information when applying for health coverage. The ACA Marketplace has strict privacy rules and does not share applicant information with immigration enforcement agencies. Information provided on Marketplace applications is used solely to determine eligibility for coverage and financial assistance.
